(MUNCIE) - The trial against a Ball State University police officer is scheduled to begin January 22nd in the wrongful death case of Ball State student Michael McKinney from Bedford.
More than 4 years ago, officials say officer Robert Duplain was responding to a call of a stranger pounding on someone's door, ultimately that stranger, McKinney, was shot 4 times by Duplain.
Subsequent tests showed McKinney's blood-alcohol level was more than 4 times the legal limit.
The US district Court in Indianapolis will hear the case against Duplain brought by McKinney's parents.
