(BLOOMINGTON) - The Pentagon is charging six Guantanamo Bay detainees with murder and war crimes for the 9/11/2001 attacks.
Prosecutors will seek the death penalty in the first test of the military tribunal system approved by Congress.
Questions are being raised about the interrogations of the suspects, but IU Law Professor Patrick Baude says it's not likely the prosecution will present any evidence obtained through the controversial technique called "waterboarding."
If their case depends on it, he says, they'll have a "tough hill to climb."
