(SHOALS) - An update on a story from this morning, State Police Jasper have changed their information regarding 49-year-old Barbara Spurgeon of Loogootee who was allegedly caught driving while intoxicated and leaving the scene of an accident.
Initially, police said the 7-year-old boy in her passenger seat was her son, but they have since corrected themselves as the boy is her grandson.
He has been released to his parents. Police also say the initial call was to a graveyard near Trinity Springs where a vehicle had knocked over a couple headstones and left before officers could arrive.
Then, a couple hours later, they were called about the same vehicle driving erratically and that's when they caught up with Spurgeon near US-50 and IN-150 in Shoals.
Police also say the drug Spurgeon was intoxicated on may have been properly prescribed to her and administered correctly which, according to the Martin County prosecutor, is a legitimate defense, should that charge go to trial. The updated report says Spurgeon has a relevant medical history.
Currently, state police Sgt. Chad Dick says Spurgeon is facing a preliminary charge of driving while intoxicated as well as a seatbelt violation and leaving the scene of a property damage accident.
Spurgeon was then released into the custody of her husband.
