(MITCHELL) - Late last year, the Mitchell City Council passed an ordinance in an attempt to change a 1979 City annexation ordinance that would allow Council Member Everett Ferrell to stay on the board even though he was not a resident of the city.
The council reportedly passed the ordinance against the advice of the City Attorney and Mayor Dan Terrell.
Mayor Terrell said that the decision made to specifically keep Mr. Ferrell on the board by the Council overstepped its bounds and passed the ordinance against the law.
Mayor Terrell stated that he directed the city attorney to file a lawsuit against the Council to get rid of the ordinance.
The Lawrence County Circuit Court and found the ordinance to be "invalid, void and of no force or effect".
The announcement happened at Tuesday (July 14th) night's Board of Works and Safety Meeting.
Everett had no comment to WBIW News at last weeks city council meeting about the situation.
