UPDATE
(MITCHELL) - At the Mitchell Board of Work and Safety meeting taking place this past Tuesday (July 14th), Mayor Dan Terrell announced the removal of a city councilman.
Councilman Everett Ferrel was officially no longer considered a councilman on The Mitchell City Council Board.
According to Mayor Terrell, the City Council voted against the advice of the city attorney and himself to pass an ordinance in an attempt to change a 1979 City annexation that would place Everett who lives outside city limits within city limits.
Mayor Terrell Informed WBIW News that during that debate Council Member Bill Arnold stated that he just wanted to "keep Mr. Ferrel on the Council", and that was the purpose voiced by a majority of the Council, according to Mayor Terrell.
During a tense discussion involving Mayor Terrel and Everett Ferrel during last Tuesday's (July 7th) City Council meeting Mayor Terrell stated that "The city attorney and I have taken the position, Everett, that you live outside the city limits... as far as I'm concerned we went to court, your house is not in city limits therefor you can't serve on the council."
Everett responding with "My attorney has told me that you don't have the authority to vacate my seat, it has to be done by a judge, or the city council."
Terrell quickly responding "I did not vacate your seat, you vacated it seat by not living within city limits"
Everett later stated "I was elected by the people, the majority of the people, to serve, and I feel I have an obligation to them that I should serve my term"
Everett made no comment to WBIW News in last weeks Council meeting, and has not yet gotten back with station with his view of the story.
According to some Mitchell residents, Everett claimed he was not aware of his final removal.
Mayor Terrell said that "Late last week Everett submitted a statement for legal fees and expenses to City Clerk-Treasurer George James. This statement was prepared by the law firm of Tucker and Tucker in Paoli apparently for work performed in defending the City Council in the lawsuit I directed the City Attorney to file. The total fees and expenses are $7,788.90. As there is no authority to pay this statement, the Board of Works has denied it."
