(EVANSVILLE, IN) - The Indiana Court of Appeals is upholding the conviction of an Evansville man convicted of beating his 3-year-old son back in 2008.
Attorneys for Terry Lay had contested the trial judge's decision to allow Lay's wife Amanda to testify in the fall 2009 trial.
Lay was convicted of reckless homicide and neglect in connection with the April 2008 death of Kalab Lay.
Amanda Lay is currently serving a 35-year prison sentence for her role in the incident.
