(MARTINSVILLE) - The family of a boy injured in a shooting at Martinsville West Middle School earlier this year filed a civil suit Tuesday.
The family's lawyer says the suit was filed against the school district. It alleges that the school had a duty to protect Chance Jackson and did not.
Michael Phelps was found guilty of shooting Jackson on March 25th. He was sentenced to 35 years in prison.
The suit claims that major entrances to the middle school were left open the day Jackson was shot, but argues that entrances should have been locked since Phelps had just been expelled.
The superintendent had no comment on the filing.
The lawyers for Jackson also requested a change of venue.
