(BLOOMINGTON) - 28-year-old David L. Burton Jr., of Bedford, was arrested by sheriff’s deputies the morning of Feb. 11 and charged with rape and sexual misconduct with a minor. He is accused of raping a 15-year-old girl in a home in Bloomington.
He is currently out of jail after posting 10 percent of his $20,000 surety bond.
He is to appear in Monroe Circuit Court March 19 for an initial hearing.
According to a report by Shawn Karr, a detective with the Monroe County Sheriff's Office, Burton was with two women and the girl at a house when Burton, who police said was intoxicated and was staying over, forced himself on the girl, groping and then raping her.
One of the women in the house said she heard the girl saying the words "no" and "stop" at 6:15 a.m. The woman said she went into the kitchen, turned on a light and looked into the living room. She reported seeing Burton, his pants around his ankles, having sex with the victim, who was trying to push him away.
The witness said Burton stopped what he was doing when the light came on. The girl said she was able to put her hands on his throat and push him off. She ran to a bedroom, and police were called.
Karr said Burton admitted being extremely intoxicated and accused the girl of initiating the sexual contact. He said he passed out and remembers nothing but waking up in handcuffs.
