(BLOOMFIELD) - A rural Linton man has been sentenced in connection with a May 2011 fight outside a downtown Linton bar.
Nick Schneider of the Greene County Daily World reports that Shan Michael Bowers, 24, entered a guilty plea to battery committed by means of a deadly weapon or resulting in serious bodily injury - a class C felony.
Greene Superior Court Judge Dena Martin sentenced bowers Tuesday to 180 days in jail with 170 days suspended. He was given credit for one day served.
He was assessed a fine and court costs.
The judge ordered Bowers' sentence to commence immediately and he was taken to the Greene County Jail in Bloomfield.
Bowers was arrested May 31, 2011 following an early morning physical skirmish with Adam Brown, that left the victim lying on the ground outside the Place Bar at 90 West Vincennes Street covered in blood.
Emergency Medical Technicians (EMTs) with the Linton Fire Department responded to the scene and transported Brown to Greene County General Hospital in Linton where he was admitted with multiple facial fractures. One of the wounds was an open fracture to the bridge of his nose that will most likely require surgery, according to a probable cause affidavit filed by Linton Police Department Officer Brock Garrison.
Garrison, with assistance from Jasonville Police Officer Ryan VanHorn and Greene County Sheriff's Deputy Brad Deckard, went to a residence at 259 NW 1st Street. While on the porch officers heard two male voices discussing some interesting details.
"The two men (later identified as Bowers and Zachery Daugherty) were discussing a fight and their roles in the fight. After listening for a couple of minutes, I knocked on the door and hear a frantic scramble inside (the house)," Garrison wrote in his affidavit.
Daugherty stepped outside his residence and talked with officers.
A few minutes later, while looking for Bowers in the house, police found a small amount of marijuana in the main room of the house.
Police also discovered some blood on the bathroom floor.
Bowers was eventually located along with another male who identified himself as Levi Moore.
Bowers and Daugherty were detained for questioning, but Daughtery was not charged in connection with the battery.
Later during an interview, Bowers said he had been in a fight with Brown. He explained that a Palace Bar bartender had asked him to leave because he was previously barred from the establishment.
"Bowers stated that as he was leaving (the bar) words were exchanged between he and Brown and it eventually led to a physical confrontation. Mr. Bowers said he hit Mr. Brown several times and that Mr. Brown hit him several times," Garrison wrote.
He said Bowers thought Brown was talking to him about an earlier fight at the Bottom's Up Bar, located about a block away.
During Tuesday's hearing, Judge Martin terminated the protective order issued protecting Brown.
