(PAOLI) - John Henry Rutherford, who was arrested on charges of reckless homicide following the accidental shooting of his wife Jody, appeared in Orange Circuit Court Monday morning.
Bedford Attorney Dave Smith was appointed to represent Rutherford.
Following his court appearance, Rutherford was released on a $2,500 cash bond.
Orange County Prosecutor Kelly Minton filed a petition asking that the court appoint a special prosecutor in the case.
Minton, citing a conflict of interest, filed the petition because Rutherford coached his daughter in softball.
Judge Larry Blanton appointed Barry Brown, a senior prosecutor from Monroe County, to serve as special prosecutor.
After Brown's investigation is complete, he will determine what formal charges, if any, will be filed.
Shortly before 6 p.m. when police were notified about a shooting at a home in the 100 block of North Franklin Street in Orleans.
There police discovered Jody had been shot and killed when John Henry was showing a 12-guage to some of his friends.
