(MARTINSVILLE) - Addam Foster, the Martinsville man who allegedly shot and killed Melissa Moore on Monday, has been charged with one count of murder as a class A felony.
Keith Rhoades of the Reporter-Times reports that Foster allegedly shot and killed the mother of his child because she was leaving him to be with another man.
Foster, 32, had been living with Moore at their home on 1420 S. Marion Street in Martinsville until June 29, when Moore moved out of their home after telling Foster that she had feelings for a co-worker.
According to Chambers, the Morgan County Sheriff's Department received a 911 call at approximately 12:51 p.m. Monday requesting police at the south Marion Street address. The call was sent to the police department who sent officers and deputies to the scene.
Foster allegedly told the dispatcher "I just shot my ex and I'm surrendering. My little girl is here."
The dispatcher relayed instructions from police to Foster who was taken into custody without a struggle.
During his hearing Tuesday afternoon in Morgan County Superior Court III, Judge Jane Craney told Foster that if he is found guilty of the crime, he could be sentenced to 45 to 65 years in prison and fined up to $100,000.
Foster, who did not show any emotion during the hearing, responded to the judge in a quiet voice throughout the hearing. The judge entered a not guilty plea to the charge on Foster's behalf. Foster told the judge he needed a court-appointed attorney and the judge appointed Monrovia attorney Steven Litz to represent him. The judge set a preliminary trial date of Nov. 14.
Both Litz and the prosecutor's office declined to make a statement.
Waited up to 45 minutes before calling police.
According to information in the probable cause affidavit, Foster gave two statements to police while being questioned. Foster identified his fiance as Melissa Moore and said that they had been together for about five years. He said they had a 14-month-old child.
Foster said he discovered "infidelity" in their relationship in January but they decided to "heal" their relationship. He said they became engaged in the later part of that month.
Foster told officers that in the recent past, he discovered more infidelity and that their relationship was going to end. He told officers that Moore was having a relationship with a co-worker and that she moved out of their home on South Marion Street on June 29.
Foster said he did not want that man to be his baby's stepfather.
On July 9, the day of the murder, Foster said he and Melissa exchanged texts. He said she told him she had feelings for her co-worker. Foster said he told Melissa he could not allow her to take their daughter and live with another man.
Foster said when Melissa arrived at the home to pick up their daughter, he "lost it."
He allegedly admitted to planning the shooting the night before, but he did not think he could do it. Foster said he made up his mind to shoot her after she told him about her feelings for her co-worker.
Foster said he saw the look of disgust on her face when she walked into the apartment. He said he "knew he was able to fulfill his planning."
During his two statements to police, Foster described how he "lured" Moore into the bedroom to get her engagement ring. He then used a pillow to muffle the shot to her stomach. Foster said after he shot her, Moore screamed at him and tried to fight. Foster then admitted to shooting her in her head. He allegedly told officers that after shooting Moore, he checked her a couple of times and well as checking on their daughter who was in another room. Foster said about 45 minutes passed before he called police.
Officers found a 9 millimeter Glock 17 handgun on the bed. Two shell casings were found and the weapon's magazine had been removed.
Officers also found two handwritten notes. Foster said the first note was written before the shooting. The second note, containing information about their daughter and phone numbers, was written after the shooting.
