(WASHINGTON) - In the Spring of 2011, due to an unauthorized ditch being cut near the Bennington Levee, the levee failed during the high water of the spring flood.
Several homes, buildings, and the City of Washington's well fields in the western part of Daviess County were threatened by the rising water.
Last week, The Daviess County Council and the County Commissioners voted to accept a mediated partial agreement concerning the south breach in the levee.
Still at issue is the repair of the south breach.
In a joint session held Tuesday morning, attorney Bruce Smith was authorized to represent the County in any litigation arising from the controversy over the south breach.
Smith said the County has received a tort notice and the County's insurance carrier claims its policy does not cover the levee problem.
