(ORLEANS) - No determination has been made on what formal charges, if any, will be filed against John “Henry” Rutherford in the shooting death of his wife, Jody, in June.
The case is still under review Barry Brown a senior prosecutor in Monroe County, who is serving as special prosecutor in the case.
Rutherford was arrested for reckless homicide on June 16.
Shortly before 6 p.m. that day, police were called to Rutherford's home in the 100 block of North Franklin Street after a report of shots fired.
When police arrived they found the body of 37-year-old Jody Rutherford. According to an Indiana State Police report 31-year-old Henry Rutherford was shooting a Stoeger 12-gauge shotgun to some young males when he negligently discharged the gun, killing his wife.
Jody was pronounced dead at the scene and Henry was arrested, then released on a $2,500 bond after an initial hearing on June 18th.
Orange County Prosecutor Kelly Minton filed a petition asking that the court appoint a special prosecutor in the case because of a conflict of interest. Minton says Henry coached his daughter's softball team.
