(BEDFORD) - Sujan Singh testified Wednesday morning that four masked men entered the Clark Station in Mitchell during the early morning of August 9, 2011 and robbed the station.
Police say Zane Payton is one of those men and his fate is in the hands of a Lawrence Superior Court II jury.
Singh, who is from India, and does not speak good English, he testified through an interpreter.
"When they rob and steal, they can also kill you," he says.
He told the jury that two of the men held him near the door, while the other two stole cash and cigarettes from the gas station.
Singh testified he was scared that he was told by the men that they had a gun.
Defense Attorney Al Mann asked Singh if he saw the gun.
"I didn't see gun, but one of them had a stick," he says.
Singh told the jury the men did not beat him or injury him, but he was very scared.
After stealing the items the men released him and fled the station.
"I locked the door and called police," Singh says. "I was scared before police came, after police came I was okay."
Lawrence County Prosecutor Michell Woodward and Deputy Prosecutor Jodi Donaldson showed the jury security video from both the gas station and CVS Pharmacy.
Mitchell Police Chief Mike Hardman and Lawrence County Police officer Tyler Trueblood who stopped a truck a short time after the robbery, Payton was a passenger in that vehicle. Both testified about their rolls investigating the crime.
Police found cigarettes; a hat wore during the robbery, and the stick one of the robbers carried into the store in the truck.
Testimony will resume this morning at 9 a.m.
