(LINTON) - 22-year-old Brittney Bailey, of Hymera appeared in Greene Superior Court and was charged with battery resulting in bodily injury to a child less than 14 years of age — a class D felony.
Anna Rochelle of the Greene County Daily World reports that an investigation began on Feb. 14 when the Linton Police Department were call from the Head Start Preschool in Linton reporting that a child might have been abused.
Bailey, who was the child's step-mother told police she had custody of the child while the child's father is incarcerated.
According to a probable cause affidavit Bailey told police the child woke up around 10 p.m. on Feb. 13 and was crying. Though she tried to get the child to go back to sleep, the child continued to cry and she got tired of it and spanked him hard.
She says she spanked the child a lot but did not hit the child in the face.
Photographs taken of the child showed bruising and red marks from the small of the back to the bottom, a bruised eye and facial scratches.
The child told police he had a nightmare after watching a scary movie and went to wake Bailey. The child says Bailey got mad and hit the child on the back of the head, lower back, bottom and back of legs.
According to the affidavit, the child was scared, was not allowed to get a drink, and did not sleep well for fear of Bailey.
Bailey was arrested, posted a $400 cash and was released from jail.
