(EASTERN HEIGHTS) - Two mediation sessions have been scheduled in the $8 million civil lawsuit Eastern Greene School District brought against the engineers, architects and contractors who built the new high school building more than five years ago.
Nick Schneider, of the Greene County Daily World reports, Eastern Greene School Superintendent Ty Mungle announced that a pair of all-day mediation sessions are slated for Monday and Tuesday at the high school.
The $16 million high school, located on State Road 54 near Little Cincinnati, opened in February 2008.
Named as defendants in the three-count suit filed in Oct. 2011 in Greene Circuit Court were: Skillman Development Corporation (Indianapolis), VPS Architecture, P.C. (Evansville), General Interiors, II, Inc. (Spencer), The Krempp Lumber Company (Jasper), and Keusch Glass, Inc. (Jasper).
The school district entered into a contract with Skillman Corp. on July 25, 2005 to provide construction management services and with VPS to provide architectural services on July 27, 2005 for the project.
The other defendants signed contracts on Aug. 8, 2006 to provide other construction-related services.
The suit alleges breach of contract, breach of warranty and negligence by the defendants.
Mungle says the school has experienced what it considers to be a variety of construction flaws.
In addition, a section of the exterior wall of the gymnasium at Eastern Greene High School was damaged April 23, 2011 by what officials believe was high winds. An eight-foot section of the upper outer east wall of the gym fell during the storm.
