(LINTON) - Three Linton men who attracted the attention of an Indiana Conservation Officer out at the Goose Pond Fish and Wildlife Area are scheduled to appear in court in October for alleged possession of marijuana.
The Greene County Daily World reports, criminal misdemeanor cases have been filed against them and they'll be charged during initial hearings on Oct. 11.
Luke Knight of Linton is facing two counts, possession of marijuana and possession of paraphernalia, both class A misdemeanors.
Seth Russell of Linton is facing the same.
Kyle Smith of Linton is facing just one count of possession of marijuana, class A misdemeanor.
ICO Mike Gregg reported that while he was on patrol around 10:30 p.m. on Aug. 22, he saw a vehicle drive back a dead-end road into Bee Hunter Marsh in the Goose Pond Fish and Wildlife Area.
Gregg said the vehicle stopped and turned its lights off, then while he watched through binoculars, he could see the occupants were lighting something.
Gregg drove back to the vehicle and reported the driver, Knight, had a suspended driver's license.
The officer reported he could smell the odor of burnt marijuana and he asked the three if there was any marijuana in the vehicle.
In probable cause affidavits, Gregg wrote that nobody answered the question, but all three of them lit up cigarettes.
ICO Matt Landis arrived to assist, and Knight was asked for consent to search the vehicle which Gregg said he gave.
Evidence, including a couple of pipes and a plastic bag containing a substance believed to be marijuana, was seized.
All three were given citations to appear in court then released.
