According to a probable cause affidavit, Tibbett, who had been drinking was verbally abusive to three children and then became physically abusive pushing one child to the ground. The victim said something to Tibbett and that is when he threw a partially full can of beer at the victim, then got on top of him, hitting him in the side of the head and kneeing him in the side.
Two female family members pulled Tibbett off the victim. The victim then went to his truck and retrieved a handgun and ran Tibbett out of the house.
Once Tibbett was outside the home the victim fired one warning shot into the air. Tibbet, who was a passenger in a vehicle, fled the scene. Police were unable to locate Tibbett after the incident thus a warrant was issued for his arrest.
