(SHELBYVILLE) - A Seymour defense attorney found himself in need of a lawyer of his own after being held in contempt of court and accused of being drunk.
According to a report from the Shelby County Sheriff's Department, Joseph Robertson II had driven from Seymour to Shelby County for a hearing Monday. A staff member accused him of touching her inappropriately on three different occasions and said he smelled of alcohol.
During Contempt of Court Proceedings, a witness said Robertson "almost ran her off the roadway on his way to the courthouse."
Police said Robertson failed three field sobriety tests, losing his balance during one of them.
He agreed to a certified breath test, which tested 0.154, the report said. He was arrested on preliminary charges of operating a vehicle while intoxicated with endangerment, operating a vehicle with a BAC greater than 0.15%, operating a vehicle while intoxicated and public intoxication.
While being interviewed by police, Robertson said he'd been drinking on the morning of the hearing, consuming "about a pint" of vodka from about 9 a.m. to 11 a.m. He left between 11:30 a.m. and noon for the hearing, driving up Interstate 65 to State Road 44 to get to Shelbyville.
Robertson practices law in Seymour and has been a member of the Indiana bar since 1981. He's also a former deputy prosecutor in Morgan County.
