(BEDFORD) - According to Lawrence County Clerk Myron Rainey, there will not be a re-count of the Mitchell Mayoral race on Monday. Instead officials will meet to discuss the next steps in the case.
According to Rainey, two attorneys; Dave Smith of Bedford, who is representing elected Mitchell Mayor John "JD" England and David Brooks, who is representing defeated former Mayor Dan Terrell; along with three members of the re-count commission will meet in Lawrence County Circuit Court Monday morning at 9 a.m.
On the commission are Republican Paul Ford, Democrat Philip Tincher and a voting machine mechanic who has yet to be appointed. Monroe Circuit Court Judge E. Michael Hoff will oversee the proceedings.
England defeated former Republican Mayor Dan Terrell 499-495. Democrat Eugene "Pud" Terrell received 229 votes with William H. "Bill the Truck Driver" Conley receiving 8 votes.
At issue is Terrell's petition claiming that people who voted lived outside of did not live within the city limits. Terrell also claims a voting system malfunctioned, and that a deliberate act or series of actions occurred in one or all of the following precincts: Marion 1, Marion 2, Marion 3 and/or Marion 4.
