(BEDFORD) - The contested Mitchell mayoral election trial is set for Wednesday in Lawrence Circuit Court.
Special Judge E. Michael Hoff will first rule on the request filed by Attorney Cody Kendall (who is representing Mitchell Mayor "JD" England) to dismiss the case.
If Judge Hoff does not dismiss the case, the hearing will commence.
Dan Terrell, who lost in the November election by four votes to England, is requesting a new election. Terrell's Attorney David Brooks claims that Lawrence County Clerk Myron Rainey, his staff, the absentee ballot board and the election board; acting alone or together; committed an act or series of acts that he/they should have known would make it impossible to determine which candidate received the highest number of votes and that the court should order that a special election be held.
Brooks says at least 40 illegitimate votes were intermingled with legitimate ones.
