(BLOOMFIELD) - A Bloomfield man who pleaded guilty in the case of a fatal accident after smoking meth in Owen County last year will serve a concurrent sentence in a related Greene County case.
Police say 31-year-old Shawn Toon caused an accident last September after reportedly smoking meth while driving. The accident took the life of 46-year-old Scott Wilding of Spencer.
Police say Toon's vehicle crossed the center line on U.S. 231 near Spencer, striking the Wilding's vehicle.
After the accident, Toon reportedly told police that he had smoked meth at his home. Police searched the home and found the meth and a smoking device, which led to additional charges in Greene County.
The Greene County Daily World reports, in the Owen County case, Toon accepted a plea agreement and plead guilty to a Level 5 felony causing death when operating a vehicle with a scheduled substance and Level 6 felony possession of meth.
He was sentenced to six years in prison, he will serve two years in the Department of Corrections and four years on home detention or work release. Toon will participate in the CLIFF (Clean Lifestyle is Freedom Forever) during the course of his incarceration.
Toon appeared in Greene Superior Court Thursday morning to plead guilty to Level 6 felony possession of meth. A Level 6 felony maintaining a common nuisance and Class C misdemeanor possession of drug paraphernalia were dismissed as part of the plea deal.
Judge Dena Martin sentenced Toon to two years in the Indiana Department of Correction. One year of the sentence was suspended and he was given credit for two days in jail.
This sentence will be served concurrently with the Owen County case, which means they will both be served at the same time.
Chief Deputy Prosecutor Keven McIntosh explained the reason for the concurrent sentence is because without Toon's admitting to having the substance in his home, the Greene County case would not have come about.
