(BLOOMINGTON) - A Bloomington man was arrested after he allegedly raped a mentally disabled teen.
According to Bloomington Police, 54-year-old Thomas A. Pemberton turned himself in at the Monroe County Jail Monday evening after a warrant was issued for his arrest. Pemberton posted a $2,500 bond and was released.
A probable cause affidavit states that police began their investigation on July 30th after a woman went to the hospital for a sexual assault examination and hospital personnel notified police.
The 19-year-old woman was then interview at Susie's Place, a child advocacy center, because of her developmental disabilities.
She told investigators that Pemberton had sexually assaulted her at his home. She also provided police with her cellphone which contained a video of the incident.
Pemberton told police he had know the teen for several years, but he didn't know her last name, phone number or where she lived. He says the teen showed up at his home unexpectedly and wanted to have sex. He denied knowing the teen was disabled, and thought she just had a speech impairment.
But police say the teen, because of her mild to moderate cognitive deficits does not have the ability to give consent.
