(BLOOMINGTON) - Bloomington Police arrested 18-year-old Andrew Passwaiter on a felony charge of sexual battery.
According to Bloomington Police Capt. Steve Kellams, Passwaiter was arrested after a teenage girl accused him of fondling her during a spring break sleepover. The 15-year-old girl told police she was sleeping on a couch and awoke to Passwaiters's hands down her pants. She then went to sleep in another room with a friend, who confirmed the incident to police.
The same day after hearing about the police investigation, Passwaiter contacted Bloomington Police on March 20th to tell them he suffers from sexsomnia - a condition in which a person engages in sexual activities while asleep. He claims he didn't know what happened because of the disorder.
However both girls claim Passwaiter was awake and not sleeping when the incident happened.
Passwaiter was arrested Monday afternoon on a felony charge of sexual battery. He continued to deny memory of the event.
