(BLOOMINGTON) - The murder trial of 49-year-old Noel Montes Cazares has been delayed until January 28th. The trial was to begin Monday.
Cazares is accused of setting a fire on February 10th that killed 85-year-old Lerae Bush. She died of smoke inhalation in the home she owned and shared with Carzares on Handy Road south of Bloomington. An autopsy showed she was alive when the fire started.
Cazares is being held in the Monroe County Jail without bond on charges of murder, arson resulting in serious injury, neglect of a dependent resulting in death and obstruction of justice.
Investigators say Cazares set fire to the building, then left to get himself a coffee and a doughnut for Bush. When he returned he told investigators the building was engulfed in flames. He told investigators he attempted to save Bush but the flames were too intense. When firefighters arrived on the scene they found Cazares sitting inside his car.
Cazares was arrested two months later. California police arrested Cazares on the day he and his fiancee Misty Allen, also of Bloomington, were getting married. Two days later Allen was arrested on charges of assisting a criminal and obstruction of justice.
