STATEHOUSE—The case against a Monroe County jailer acused of tasing an inmate to death will proceed following the Indiana Court of Appeals’ refusal to hear a request to dismiss the charges.
David Shaw faces felony battery charges in the November 2003 death of James Borden of Bedford. Shaw shocked Borden multiple times with a taser after Borden became uncooperative, and Borden died soon after.
The special judge in the case halted proceedings in June to allow the State Court to hear Shaw's appeal. The next hearing in the case has yet to be scheduled.
