(ELKHART) - No charges will be filed against an Illinois truck driver who rammed into stopped traffic on the Indiana toll road, killing eight people.
The Elkhart County prosecutor says 32-year-old Leonardo Cooksey of Mount Prospect, Illinois, may have been negligent in his actions on April 26th, but he was not criminally responsible.
Cooksey was recharging his cell phone and didn't see the stopped traffic until it was too late.
A state police investigation showed no evidence that Cooksey attempted to brake before he struck vehicles that had stopped near a construction zone about 20 miles east of South Bend.
