Officer Went Too Far, Says Court Of Appeals

(INDIANAPOLIS) - The Indiana Court of Appeals says a police officer overstepped the boundaries of the state’s seat belt law when he asked a man following a stop if he was carrying anything the lawman should know about.

The court reversed Gary Pearson's conviction in Warrick County on charges of possession of methamphetamine and possession of marijuana -- along with the seat belt infraction.

Pearson was stopped for driving without a seat belt in 2004 by a Chandler police officer who asked him to step out of the car so he could do a pat-down search for weapons.
