(INDIANAPOLIS) - The Indiana Court of Appeals says the state can pay nurses at state hospitals more than their supervisors if it wants to.
The court has reinstated an overlapping salary scale for supervisors and night nurses. A Madison State Hospital supervisor has been fighting the grid in court for seven years.
Governor Frank O'Bannon raised night nurses' pay because it was too hard to find nurses willing to work that shift.
A unanimous appeals court says if the state can lay out a legitimate reason for pay differentials, there's no grounds to challenge it.
