State House Prayer Suit Thrown Out On Appeal

Last updated on Wednesday, October 31, 2007

(CHICAGO) - A federal appeals court has thrown out the lawsuit which banned specifically Christian prayer from the Indiana House.

But the court didn't rely on religious freedom as the basis for its ruling. Instead, a 2-1 majority says the people who brought the suit aren't qualified to sue.

The suit began from the premise that Indiana was spending tax dollars to support religion. The court says the only tax money the state is spending is a few bucks to send invitations to guests invited to give the daily opening prayer.

House Speaker Patrick Bauer says he's "delighted" at the ruling.
