(FRANKLIN) - A stay of execution has been granted for the man convicted of the 1997 rape and murder of Franklin college student Kelly Eckhart.
The ruling from a federal judge allows time for an appeal based on the claim that Michael Overstreet is not competent to be executed and had ineffective counsel at trial.
His trial lawyers presented no evidence of mental illness and failed to object when courtroom spectators wore buttons bearing a picture of the victim.
Overstreet had been scheduled to be put to death by lethal injection May 30th.
