(FISHERS) - It’ll be at least three weeks before there’s a ruling in the Fishers-Geist annexation battle.
Fishers had sought a quick knockout after two days of testimony on its annexation bid, asking a judge to throw out Geist homeowners' challenge to the plan. Instead, both sides have agreed to submit final written arguments by December 15.
Hamilton Superior Judge Steven Nation will rule on both the dismissal motion and the merits of the case sometime between that date and late February.
The dismissal request contends opponents didn't present enough evidence to allow a judgment on the merits. Fishers attorneys argue Geist United Opposition needed to reestablish the minimum 65% of landowners object to the annexation, following passage of a state tax-reform law. Geist United attorneys reject that interpretation.
If the dismissal request is denied, opponents' hopes of blocking the annexation rest on persuading nation the annexation either creates a financial hardship, or lacks an adequate plan for supplying municipal services to the area.
