(INDIANAPOLIS) - Liability claims against Chrysler Corporation could all be “swept away” in their bankruptcy proceedings, which would be bad news for an Indianapolis man.
34-year-old Jeremy Warriner is in the middle of suing the automaker for a defect in his Jeep Wrangler that led to a fire after a traffic accident in October 2005.
The fire caused Warriner to sustain 4th degree burns on his legs which resulted in a double amputation above the knee.
Warriner's Attorney Mick Peek says after numerous expert investigations and depositions the case had been scheduled for mediation, but that has since been suspended because of the bankruptcy filing.
Warriner's case and others like it are classified as unsecured creditors, which under the current proposal in bankruptcy court, would be dismissed.
Peek says the bankruptcy proposal calls for a "new" Chrysler Company to be formed in the merger with Fiat with all pre-bankruptcy warranties observed but no pre-bankruptcy liabilities paid.
Warriner says his case and others should have their day in court and should not be dismissed.
