(INDIANAPOLIS) - The family of the 5-year-old child critically injured at an indoor amusement park in Indianapolis last week has filed a lawsuit against the park.
Denzel Jennings was on the tea cup ride at Xscape at Lafayette Square Mall when the ride went too fast, causing him to hit his head multiple times, fracturing his skull.
The center didn't have an amusement and entertainment permit and had not been inspected. Attorney Thomas Doehrman says the suit includes an injunction to keep the ride closed and untouched until a thorough inspection is completed.
The state fire marshall's office closed the business immediately following the incident. The business has since re-opened, however the ride itself remains closed.
Meanwhile, Denzel remains in critical condition in a coma in the hospital.
