(UNDATED) - A lawsuit filed by three school districts challenging the way Indiana distributes education funding can go to trial following a ruling by a Hamilton County Superior Court Judge.
The state recently moved to have the suit, brought by Hamilton Southeastern, Franklin Township and Middlebury Community Schools thrown out of court, arguing that schools are state entities and lack legal standing to sue the state.
But Judge Steven Nation ruled that prior case law establishes that schools have the power to file suit.
