(UNDATED) - The Indiana Recount Commission has filed an intent to appeal a judge’s ruling ordering another hearing on the candidacy of Secretary of State Charlie White.
The recount commission previously ruled 2-1, dismissing state Democrat's challenge to White's candidacy.
However, Judge Louis Rosenberg ruled Democrats' arguments on voter fraud allegations were valid and ordered the panel to rehear the case.
White Attorney Jim Bopp says they want the law clarified "we think the judge requiring the recount commission to make, essentially, a criminal finding of fraudulent voter registration really compromises my client's defense and constitutional rights in his criminal trial".
The request has not yet officially been filed.
