(UNDATED) - Democrats are asking a judge to reverse last month’s recount commission ruling that Secretary of State Charlie White is eligible to hold the job.
State Democratic Chairman Dan Parker isn't commenting beyond a written statement noting the commission scolded White for treading close to the line during a messy transition from his fishers apartment to a condo with his new wife.
The statement calls the appeal the equivalent of an NFL booth review.
White's Attorney Jim Bopp says he's surprised at what he calls a "quixotic" appeal.
He notes the Bipartisan Commission voted unanimously in White's favor.
Marion Circuit Judge Louis Rosenberg has already reversed the commission once, ordering the panel to conduct a full hearing on White's residency after an initial vote to dismiss Democrats' challenge outright.
Bopp notes that commission vote, unlike the final decision, was along party lines.
A Hamilton County judge has granted a one-month delay in white's criminal trial on similar allegations.
