(HAMILTON COUNTY)- Fishers police said an 8-year-old girl and a 13-year-old boy were caught in a sexual act on a school bus.
RTV6's Eboné Monet reports the girl's parents are now trying to determine if the February incident was a rape or molestation.
In a statement, police said a bus aid caught the girl and the boy "trying to have intercourse," and that the "bus aid immediately separated the juveniles and informed the bus driver."
Investigators said although the students attend the Indiana School for the Deaf in Indianapolis, the incident happened on a Noblesville Schools District bus during a Hamilton County drop-off route.
The Hamilton County Prosecutor's Office has decided not to file any charges against the 13-year-old boy, the aid or the bus driver because police said video surveillance showed no force during the incident.
Attorney Robert King spoke on behalf of the girl's family.
"When the incident was discovered, a larger, older boy was found in control of a smaller, younger girl. The parents of the young victim will continue to combat any efforts to minimize, excuse or depreciate the grave and serious harm that was caused to their daughter," King said.
Noblesville residents were shocked after learning of the incident.
"I couldn't believe it. If my daughter had any sort of sexual intercourse at that age, I'd probably be embarrassed and I would probably kill somebody," parent Janelle King said.
"I think it's crazy. It just shows nowadays that you have to prepare your kids to have the talk before they enter grade school now," parent Brandy DeMichieli said.
The girl's parents declined to comment about the incident.
