(VALPARAISO) - A former Vincennes University student is appealing his rape conviction in a sexual assault on another student who later committed suicide.
Jason Michael Palilonis argues that jurors shouldn't have been told that the victim wasn't available to testify because she was dead. He also claims the trial court improperly admitted statements the victim made to a nurse after the alleged assault and abused its discretion by denying his motion to set aside the guilty verdict because one of the jurors allegedly told others the judge believed Palilonis was guilty.
Palilonis also disputes the admission of statements made by the nurse and his own statements to police.
The Indiana Court of Appeals will hear oral arguments in the case Monday at Valparaiso University's Wesemann Hall School of Law.
