(INDIANAPOLIS) - More details were revealed Monday afternoon in a case against a suspended Indianapolis Metropolitan police officer.
Troy Kehoe and Jay Hermacinski of WISH TV8 report that David Bisard has been charged with operating a motor vehicle while intoxicated and operating a motor vehicle with a blood alcohol level greater than .15 grams, both Class A misdemeanors.
Bisard had a BAC of .22, according to court documents.
The charges were filed Monday by the Marion County Prosecutor's Office.
Lawrence police arrested Bisard on Saturday for drunk driving.
According to a probable cause affidavit, while Bisard and police were enroute to Wishard Memorial Hospital for his blood draw, he said, "I made my bed and I'll lie in it." He also reportedly said, "I wish I could make this DUI go away," and, "My life is over."
During the blood draw at the hospital, Bisard said, "There will be alcohol in there," according to court documents.
Court documents reveal plastic water bottles, a McDonald's cup with liquid in it, a plastic bag containing a vodka bottle with liquid and cranberry juice were among several items found in the car Bisard crashed on Saturday.
The car belongs to Bisard's stepfather, who said he doesn't drink alcohol and didn't buy the vodka, the court document said.
The Prosecutor's Office filed a motion to revoke bond from charges filed against Bisard after an alleged 2010 driving accident that killed one and injured two others.
"Given the circumstances we believe the defendant would be a danger to the community" said Terry Curry, Marion County Prosecutor.
That case was transferred to Allen County Superior Court and is set for trial on Oct. 15.
Curry says it is unclear whether the two cases will be linked together during the trial.
"As we sit here at this point certainly they are two very distinct cases. It is premature to know whether it will have any pertinence to the 2010 case and certainly the more serious of the two cases" said Curry.
An initial hearing in the new case is at 8:30 a.m. Wednesday in Marion County Court 10.
Prosecutor Terry Curry filed a motion Monday with the Allen County Superior Court, where Bisard's case was moved because of media publicity, asking for Bisard's bond from the 2010 case to be revoked. He told News 8 that the terms of that case allow bond to be revoked for "good cause," and that a new arrest should qualify.
Judge John Surbeck's court staff in Allen County told 24-Hour News 8 they received that motion late Monday, but that the matter had not yet been put on the court's calendar. A court spokesperson said it was unlikely the request would be heard before Friday afternoon.
Bisard's newest legal case won't be financed by the Indianapolis Fraternal Order of Police. The FOP is currently reviewing whether to continue its financial support of his 2010 case.
