(NOBLESVILLE) - Moped drivers in Noblesville going faster than 25 miles per hour on 49cc mopeds are being warned to abide by the law or their mopeds could be impounded.
Sandra Chapman, of WTHR reports, Mike Reed enjoys riding his small moped, especially with the spike in gas prices. But a week ago as he approached the Hamilton County Sheriff's Department, he was pulled over in a 35mph speed zone. He wasn't speeding for that road but under Indiana law mopeds that size are not to exceed 25mph.
Reed, who has a driver's license, said he was warned his moped would be impounded if he was caught going over the so-called "manufactured speed."
Hamilton County Sheriff Mark Bowman told Eyewitness News he's seen more mopeds on the road and that his deputies are trying to keep everyone safe. He said it would help law enforcement if lawmakers would clear up confusion in state moped law.
Right now, Sheriff Bowman said the mopeds are built to go faster, and at speeds over 25mph they are considered a motor vehicle, just like a motorcycle.
Indiana lawmakers were close to requiring registration and plates for mopeds last year, but the measure stalled.
For now Bowman is warning drivers of 49cc mopeds to travel below 25mph and to carry some form of state identification. Drivers must also be 15 years old.
