(JOHNSON CO.) - A Whiteland man was accused of DUI while speeding on a moped though Johnson County, police said.
Just before 11 p.m. Sunday, police spotted a man and a woman speeding on a blue moped on State Road 135 near Smith Valley Road. Police said the moped didn't have a license plate and that the driver waved at the officer behind him to pass him.
When police stopped the man on the moped, the officer said he noticed the strong smell of alcohol and the driver's eyes appeared to be red and glassy.
After running a driver's license check, police said the driver, identified as 31-year-old Joshua Marksberry, was listed as a habitual traffic violator.
The officer gave Marksberry a Breathalyzer test and the results were 0.216, more than twice the legal limit of .08.
Police said Marksberry was uncooperative while being taken into custody. He was charged with DUI and habitual traffic violation.
The woman riding the moped with Marksberry was identified as Melissa Pittman. She was not charged.
