(UNDATED) - An Indiana congressional candidate is simultaneously running for Senate in Tennessee — and isn’t a resident of either state.
Erin Magee is one of five Republicans seeking the nomination to oppose Seventh District Democrat Andre Carson. He's also challenging Tennessee Senator Lamar Alexander, and running for Congress in his home state of Florida.
Valerie Kroeger with the Indiana secretary of state's office says it appears to be legal. Although candidates normally can't run for two offices at once, Magee is running for Congress.
Kroeger says a U.S. Supreme Court ruling declared states can't add any eligibility rules for Congress to those spelled out in the Constitution.
Magee's Florida residency doesn't disqualify him either. The Constitution requires only that a candidate for Congress be a resident of his state on Election Day.
Democrats successfully removed New York attorney William Bryk from the Eighth District ballot, using a new state law passed after he made a first run for the seat two years ago.
Indiana primary candidates now must prove they voted in the previous primary under party banner they claim. But Republicans didn't challenge Magee, and the deadline to do so has passed.
