(BEECH GROVE) - The City of Beech Grove has filed a lawsuit in Marion County Superior Court against Franciscan St. Francis Health Alliance.
The suit seeks at least $1 million in damages.
Mayor Dennis Buckley says this follows at least two years of the city having to deal with storm water drainage run off from the St. Francis campus in Beech Grove.
Buckley says St. Francis' groundwater has infiltrated the city's sanitary sewer system and the city has been paying big money to treat it. The Mayor says the city has to pay every month and the practice must stop.
The lawsuit seeks $1,000 per day of impermissible flow for at least two years, other recovery fees and the Mayor says they want St. Francis to fix their system and provide restitution for treatment.
The Mayor says they've repeatedly tried to work with St. Francis to no avail.
St. Francis Spokesman Joe Stuteville says it's too early to comment on the suit.
