(INDIANAPOLIS) - An Indianapolis man convicted of raping his wife was sentenced to five years behind bars for a probation violation in the 2011 case.
David Wise was sentenced to eight years of home detention and 12 years suspended in May 2014. Under those terms, he would not have had to serve time in prison.
However, because he violated his parole, he will now have to spend five years in prison and three years home detention. He will have to serve an additional two years of probation after home detention.
A jury found Wise guilty of rape and criminal deviate conduct.
In court Thursday morning, the judge called Wise a "300-pound gorilla."
His ex-wife Mandy broke down in tears saying she is thankful the judge is sending him to prison and that for the next five years, she and their 15-year-old son and 12-year-old daughter won't have to live in fear about him living around the corner.
