(INDIANAPOLIS) - Saturday morning IMPD detectives arrested 22-year-old Briana Holland of Indianapolis on a preliminary charge of neglect of dependent after a newborn baby boy was found in a trash can in an westside business on Friday night.
After being questioned by detectives, the suspect was arrested at approximately 5:00 am Saturday. Detectives believe that Holland gave birth to the unnamed infant at the facility and then abandoned the child in the building's bathroom.
The boy is in good condition at Riley Hospital for Children in the custody of case workers with the Department of Child Services. The boy had initially been listed in critical condition.
The suspect was transported to the Arrestee Processing Center for processing and will wait an official charging decision by the Marion County Prosecutor's Office.
Indiana's Safe Haven Law allows a person to give up an unwanted infant anonymously without fear of arrest or prosecution.
A parent, family member, friend, minister or priest, social worker, or any responsible adult may give custody of a baby less than 30 days old to a hospital emergency room, fire station or police station in Indiana.
A child can be taken to a hospital, police station, or fire department anonymously where they will then be cared for.
IFD says they've only had a few instances of that, but firefighters are always ready.
"Their first assessment would be to the medical attention to that child. Their first phone call would be to get an ambulance on the way and their second phone call would be to IMPD to get the appropriate agencies," Capt. Reith said.
From there, Child Protective Services gets involved.
