(UNDATED) - Speedway Police say a man accused in the fatal shooting at the Coke Lot in Speedway the day before this year’s Indianapolis 500 was arrested Monday.
Avory Johnson was arrested in Hurst, Texas which is just outside of Austin.
Police say Johnson allegedly shot and killed Max Levine in the Coke Lot on May 24. Johnson was taken into custody that same day but was later released.
Police said several witnesses in the case were not kept separate from one another and the Marion County Prosecutor's Office decided not to file charges at that time.
The investigation continued and the prosecutor's office decided there was enough probable cause to charge Johnson in the shooting. A warrant for Johnson's arrest was issued on August 20.
Lt. Trent Theobald with Speedway Police says Johnson had moved to Texas but police kept tabs on him because the investigation was ongoing. He says since they knew where Johnson was, communication with the Hurst Police Department allowed for a quick arrest.
Johnson is awaiting extradition back to Marion County where he will be formally charged.
