(SOUTH BEND) - A northern Indiana woman’s lawyer is seeking the dismissal of a feticide charge she faces in the death of her baby whose body was found in a restaurant trash bin.
The defense attorney for 33-year-old Purvi Patel of Granger also argues in a court filing that investigators improperly questioned her in a hospital without reminding her of her legal rights.
Patel also faces child neglect charges over the death of the infant, whose body was found outside a Mishawaka restaurant in July 2013. Court documents say Patel told doctors the baby was stillborn, but a pathologist ruled the infant was born alive.
The South Bend Tribune reports defense attorney Jeff Sanford also wants the judge to not allow images of the baby in the trash bin during Patel's trial.
