(INDIANAPOLIS) - The Indiana Supreme Court has issued an order throwing out the last remaining constitutional challenge to Indiana’s right-to-work law banning mandatory union fees.
The (Munster) Times reports the state's highest court on Wednesday released an order vacating a Lake County ruling that found the 2012 law unconstitutionally required labor unions to provide services to nonunion members without compensation.
Local 150 of the International Union of Operating Engineers had argued in the Lake County case that federal labor law required it to represent all employees in a bargaining unit, but the Indiana Supreme Court ruled last month that that occurs only when a union chooses to be an exclusive bargaining agent.
The 7th U.S. Circuit Court of Appeals also upheld the Indiana law in September.
