(INDIANAPOLIS) - Just four days before the Indianapolis Colts play for the AFC Championship, linebacker Josh McNary was charged with rape, criminal confinement and battery.
Court documents filed Wednesday say the charges stem from an incident in the early morning hours of December 1 in which 26-year-old McNary allegedly sexually assaulted a 29-year-old woman inside his downtown Indianapolis apartment. McNary and the victim met at a downtown bar and went to his apartment after she admittedly had several alcoholic drinks.
The victim told police she was inside McNary's bedroom when he allegedly tried to kiss her neck after which she tried to push him away, according to court documents. She said McNary became upset and a fight ensued between the two, during which she scratched his back, side, neck and face. It was after this when McNary allegedly raped the woman despite her telling him to stop multiple times.
The woman said she snuck out of the apartment after taking McNary's cell phone and called police when she returned home. Investigators used the phone to identify McNary who later provided police with clothes the woman left in the apartment as well as his bed sheets.
When police arrived at his apartment, McNary said "I know why you're here," court documents say.
A warrant for McNary's arrest was issued Wednesday but as of Wednesday evening, no arrest had been made.
The Colts released a prepared statement Wednesday afternoon, saying, "We are aware that there has been a report about Josh McNary, but unfortunately that's the limit of our knowledge. At this time we are very concerned and trying to find out what the relevant facts are but we have insufficient information to venture any opinion. As we learn more we will make appropriate updates."
